NP'S LEAGAL WISDOM

                        NP'S LEGAL WISDOM

( 35 )
" Life belongs and is fundamentally responsive to the biological/physical condition trapped in the mundane laws of
the Earth. While the mind is a massive legislative house and cradle of all the principles of living that have yet been
framed and are yet to be framed, one that is enlightened with the true laws of life
moves safely through any conditioned living and does not need the coded principles
as its safety guide. "

( 34 )
" Which laws do govern the universe-- laws
of nature or laws of God? It seems neither
if we look at our own planet which is governed by our own laws. Then certainly
we intervene in, or interfere with, the natural/divine laws, for we know our planet
is a product of the universe or God.
Whatever, the consequences of the human intervention, or our interference, can be judged by how we are related-- to environment, to religion, to science & technology, and, above all, to ourselves. "
-- N P Samal

( 33 )
"Litigation is a legal rope that binds the two litigants together and gets stronger as the
suit lingers and tightened yet more each
time by the two seemingly opposing advocates."
-- N P Samal

( 32 )
" Life for human beings means living by the laws of the existing socio-economic-political system which is their own make.
While the rest of the organisms live freely
by the pure laws of the Nature,
human beings design their living with the crudeness of their artificial laws which
bend and break under the pressure
of economic, political and social changes.
While the other species have survived the
'natural changes' through millions of years, human beings have constantly faced
survival crisis, as many civilizations have perished in the last few thousand years. "
-- N P Samal

( 31 )
" Our reactions now are how we have
reacted since our childhood. It means how our family members, neighbors, relatives,
and others have acted upon us in our
formative phase of life. Apart from being
this behavioral, through our experiencs as such, our reactions may be
hereditary / genetic / biological,
or environmental...
Hence, any lawsuit connected to human disputes faces challenges for a quick finish
(if intelligent and experienced advocates
are involved).
-- N P Samal

( 30 )
" The Bible verses or those of the Gita or the Quran or any other, these are all Divine Instruments which inspired the making of
all civil laws. Had humanity followed the
civil laws in letter and spirit, the criminal laws would not have even been gestated.
Our defiance to the Authority of the Scriptures has opened the apocalyptic Pandora's Box that we cannot ever close it back. "
-- N P Samal

( 29 )
" Jurisprudence, as known to the whole
legal fraternity, is as long as from
the prehistoric world to the 21st century world and, en route, it has rendered substantial services to the existence of the legal system as relevant in respective societies. And at present, as the modern world is going through fast political
and social changes, it is only the jurisprudence that can guide humanity through a safe passage. "
-- N P Samal

( 28 )
" Conflicts are more between the peoples belonging to two immediate Demographic Cohorts than among those who belong to
the same Cohort. In reverse, cooperation, compromises, tolerance, and other certain virtues are stronger among the latter.
This fact is apparent if you have studied the
human affairs vis-a-vis social changes
since the Nearly Extinct Generation to the Silent Generation, to the Gen X, Gen Y, Gen Z,
and Gen Alpha peoples. And the larger
is the gap, the more estranged, indifferent,
and alienated are they. "
-- N P Samal

( 27 )
" Atoms came together to form molecules, molecules compounds, compounds single-celled organisms, single-celled organisms multicellular organisms, multicellular organisms societies...
The evolution of life which began 3.8 billion years ago has now reached its latest form, humanity, all through 'natural bonding'.
The Natural Bonding is the
sine qua non of humanity's survival and progress to its Ultimate Form--Homo Deus (Godlike Human/s)...
And in front of the Creator's Natural Laws
of evolution of life on this planet,
the present 'all-powerful' human species
are infinitesimally insignificant. "
-- N P Samal

( 26 )
" The ancient-agers lived differently from
the medieval-agers. And the modern-agers live differently from the both.
And do take note:
The post-modern-agers will live differently
from all the three...
Let alone these long periods, even our
parents live/lived differently from how we live now, and how our children live
creates new challenges for us
to parent them...
Many of our laws are, thus, rendered
inapplicable with the passing of generations, and the legal professionals
have but to muddle through those laws. "
-- N P Samal

( 25 )
" When dishonesty raised its head,
we became corrupted.
Then it became necessary to invent laws...
The soul of the honest humans do not get corrupted and they do not need any laws, other than the laws of Nature, to live. However, it is extremely trying to practice honesty, for it requires deep penance.
And those who tolerate the penance
become saints. "
-- N P Samal

( 24 )
" We create doctors promising them to provide sufficient patients (by causing accidents, fights..., or through our lifestyles), engineers sufficient destructions (through wars, bombings.., or praying for natural disasters), advocates sufficient cases (by inciting conflicts, violence, etc.)...
After all, what will they live on?
We all are 'cannibals' of the modern civilization, feeding on each other
to survive. "
-- N P Samal

( 23 )
Our lineage, scientifically, is about 5 million years, and if we believe in Christianity, it is nearly 8000 years, or according to a
different source, around one lakh yesrs,
since Adam and Eve. This human lineage
may well extend to further millions, or thousands, of years. But we each live for
just around 75 years, and, during,
see our parents for 50 years and our children for 50 years.
Our laws must address the true definition
of life in solving the disputes of living.
-- N P Samal

( 22 )
" Food, sex, and physical safety are the
THREE ESSENCES for survival.
They create natural wants in us and to
fulfill them, we become loving and cooperative. But our life
is more synthesized than natural now,
which is resulted in conflicts and competitions, making us selfish and aggressive. All crimes, offences, rebellions,
and wars now are due to our synthetic
living-- completely estranged to Nature.
So are our laws. "
-- N P Samal

( 21 )
" Your pains and pleasures, along with your self (or soul), are yours. And mine are mine.
None can share one's with the other.
Yet none can live alone. And to live together, you have got to depend upon me
and I on you. While interdependence
needs compromise by each, any disturbance therein causes ripples in our relationship, threatening our coexistence. Imagine, there are over eight billion people in the world...
To save us from the inevitable
codestruction, the whole existing laws
are too impotent. "
-- N P Samal

( 20 )
" If you are an intellectual, you know that
our present 'conditioned life' produces
more losses than wins.
Hence, in our legal system (in fact,
in every existing system of the world),
there are more losers than winners.
The cause is our own ESOTERIC world. "
-- N P Samal

( 19 )
" There has been constant collision
between our progressive systems and regressive systems, and social dynamism
and social staticismwhich causes the laws stumble, limp, or deviate while taking
their course. This is another cause of the
judicial pendency, and this
cause is stronger than advocacy.  "
-- N P Samal

( 18 )
" Since when the human beings got caught between 'selfish instincts' and 'selfless instincts', their transformation started from being 'noble savages' into 'ignoble sapiens'. This 'human condition' brought
the statutory laws into being and made
those laws A GAME
in the advocates' hands. "
-- N P Samal

( 17 )
" Life is akin to love. And there are loves abound... Loves create wants, wants create desires, and desires look for means to get
the things desired. Some means have
been mended, some not.
While the things are limited, along with the means, there are unlimited aspirants.
This situation creates competitions, conflicts, violence, and other vices...
Hence, the laws. "
-- N P Samal

( 16 )
" The outflow of the legal cases must match their inflow. Any deviation in one causes swelling or wilting of the conduit-- an ailing condition either way. In the present legal system, it is swelling up, constantly.
The measures, like Lok Adalat, etc. cannot clean the clogged exit door permanently... "
-- N P Samal

( 15 )
" Advocates make merry over the filing of cases, and the more the cases linger,
the merrier they become...
While the Nation has long been worried
about the slow pace of the lawsuits,
if the pendency is ZERO,
the majority of the advocates and
their clerks will return home empty pocket...
The quicker are the settlements,
the poorer are the professionals. "
-- N P Samal

( 14 )
" The whole organisms of Earth are cozily nestled between the laws of Creation
and the laws of Destruction
designed by Nature. Humans are the only
species who enjoy creating things
and destroying things of their own
and make their futile laws to live through
this self-own misfortune. "
-- N P Samal

( 13 )
" The laws are mostly over human-effected false reality of living that subjects them
to conflict-prone wild emotions...
Our three-generational short existence
is made too complicated
which generates many draconian laws. "
-- N P Samal

( 12 )
" The laws are the reasons that intervene in other fighting reasons. And all human-conceived reasons are not necessarily reasonable, for, our reasons are not based
on absolute facts,
epistemologically. "
-- N P Samal

( 11 )
" All laws are draconian. If not to you, they are to me. If not to us, they are to others...
No laws can cut across the world's whole people rigidly conditioned by the artificial divisions like religions, faiths, classes, cultures, wants, desires, politics, and what not, and nature-made divisions in ecological, geological, biological, and demographic conditions. "
-- N P Samal

( 10 )
" The scriptural laws of the religions influence human beings more than the codified laws.
CAUSE:
The formers relate to God Who we think we belong to Him, while the latters present themselves as a grotesque stranger. "
-- N P Samal

( 9 )
" The purpose of the laws is to organize human beings, protect their rights and liberties, settle disputes, establish peace, etc., etc.. Has the purpose yet been met, even after thousands of years of their course?
They cannot however long is further the course, for they grow in confrontation with the human primal instincts. "
-- N P Samal

( 8 )
" Our fears and our interests. There are only these two things that all the laws develop on, revolve around, and deal with.
The problem is many of our fears are irrational and interests artificial. "

-- N P Samal, academic, author, poet, writer

( 7 )
" The laws, like the State, are a necessary evil, and will remain so till the end of the present 'human condition' which promotes and
prides on the mundane living.  "

-- N P Samal, academic, author, poet, writer

( 6 )
" Children and grandchildren are integral part of every human life (at least as death is inevitable). But I have been denied both, and for me death is not only inevitable but
also imminent. And before my death, I have got to admit that our own laws of living have corrupted the Genuine Laws of Nature. "

-- N P Samal, academic, author, poet, writer

( 5 )
" There live two persons in each of us. One is 'competitive, aggressive and selfish' and the other is 'cooperative, loving and selfless'. And, so, we each are self-contradicting,
whose by-product are the laws. "

-- N P Samal, academic, author, poet, writer

( 4 )
" Human beings make laws against the crimes and offences they themselves commit and break the laws they themselves regulate. Doesn't it sound interesting?... We all are idiots. We have not discovered us yet, and cannot discover till we are fully evolved. "

-- N P Samal, academic, author, poet, writer

( 3 )

" When the first laws of humanity were codified about 4000 years ago, they meant to change the savage humans into civilized humans. And now, as laws are still essential for human beings, we have not been truly civilized. We still are savages-- only in civilized clothes. "

-- N P Samal, academic, author, poet, writer

                                     ( 2 )

"A law against violence. A law against injustice. A law against inequality. A law against corruption. A law against exploitation... There are many vices, and, so, there are many laws... Human beings are the only species on the planet who require laws to live... But the future humanity will have no vices. There will be no laws, or lawyers, or courts, or police, and each one will be a "judge" themselves, pure, immortal..."

-- N P Samal, author, poet, academic, writer

 ( 1 )
"Taxes are the only way toward establishing the long-desired egalitarian society, if only the politicians, who formulate taxes, do not themselves stand in the way. And the more the life grows wantful and costly, the heavier gets the burden of taxes, and more complex as well..."

-- N P Samal, author, poet, academic, writer
